The jurisdictional and forensic difficulties inherent to the collection of digital evidence have been intensified by the growing use of cloud computing technologies. The increased volatility of such evidence due to the easiness in which it may be altered or eliminated remotely by its owner or a third party has highlighted the need for transborder access to digital evidence and for procedural measures of a more invasive nature. The provisions introduced by the Portuguese legislator on these matters, though innovative and efficient, are not without controversy.
