O SISTEMA PENITENCIÁRIO BRASILEIRO E O PRINCÍPIO DA DIGNIDADE DA PESSOA HUMANA

Resumo Este artigo discute a relação entre o princípio da dignidade da pessoa humana e o sistema penitenciário brasileiro no que pertine à inobservância das garantias presentes no ordena-mento jurídico. Utiliza-se a metodologia de pesquisa bibliográfica, sobretudo com consulta a obras de referência, meios eletrônicos e revistas. Objetiva-se demonstrar a falência do sistema penitenciário brasileiro, uma vez que as práticas cotidianas no ambiente prisional e de aplicação da lei penal implicam, algumas vezes, violação dos direitos fundamentais dos apenados. Aborda-se, então, a importância e a necessidade de considerarmos o Direito Penal como ultima ratio do sistema, ou seja, um direito penal mínimo, justamente para que seja salvaguardado o princípio da dignidade da pessoa humana. THE BRAZILIAN PENITENTIARY SYSTEM and THE PRINCIPLE OF HUMAN DIGNITY Abstract The proposed theme for this article is the legal principle of human dignity and the Brazilian prison system. Developed through a literature review in the legal field, as well as the electronic media queries, magazines, newspapers, among others, aims to demonstrate the failure of the Brazilian penitentiary system, given that it confronts the constitutional principle of human dignity. Therefore, through this article, we intend to address the importance and necessity of introducing in the criminal law field a Minimum Criminal Law for the individual to have secured the minimum rights and guarantees inherent to the human being, especially with regard to the dignity of the human person.
