Quertek KODE®Upgrade v.1.1 Terms of Service Agreement

Terms of Service This agreement is written in English (US). To the extent any translated version of this agreement conflicts with the English version, the English version controls. Date of Last Revision: May 15, 2016 This Terms of Service (also known as “Terms”, “Statement”, or “ToS”) derives from the Quertek Mission and includes the terms that govern our relationship with users, individualoperators, and others who interact with our Übermaterial® supplements and services, such as KODE®, and specifically those users who wish to install the KODE®Upgrade v.1.1. By using or accessing the KODE®Upgrade v.1.1, you agree to these Terms, as updated from time to time in accordance with our Modification of Terms Policy (see Other). Additionally, you will find resources within this document that help you understand how our products work. 1. Mission Quertek Inc. is a decentralized autonomous organization, committed to the creation of optimized subjective experiences. To address this, Quertek brings together a diverse team of collaborators to systematically and comprehensively tackle the necessity for a universal mastery of creativity and an intensification of consciousness through our open-source Übermaterial® supplements and services. Quertek works at the cutting-edge TOTALFrontier of the molecular revolution in soft machine technology, KODE® development, mobile idea production, lifestyle-integration experimentation, and Perceptronium® modeling. We invest in the future of the species. 2. Definitions / Disambiguations By “supplements and services” we mean the products we make available, including (a) our Übermaterial® range and any other co-authored open formats, including user-variations, modifications, and re-distributions; (b) our KODE® biogenetic design software and its Upgrade v.1.1; (c) items included in the Intermorph Upgrade starter suite and all relevant source-code derivations generated from individual-operator input/output sequences; (d) our spatial formats, including MountGrove (Amerika); and (e) supplements and services now existing or later developed. Quertek reserves the right to designate, in its sole discretion, that certain of our products, including co-shared, co-developed, co-authored, and/or co-operated formats, are governed by separate terms not included in this ToS. By “KODE®” we mean a matrix of potential techno-ontic design parameters that are able to unfold in multiple directions within the pre-individual field, known as the Morphic Programming Interface (MPI). KODE® introduces an Integrated Development Ecology Platform (IDEP) on top of the pre-individual MPI in order to supplement IndividuationInteractions algorithms that compile and translate specific execution unitstreams. By “KODE®Upgrade v.1.1” we mean the bio-compatible incorporation and application of KODE® design software into the user's human biocomputer, resulting in (a) the overcoding of user API+IDE with a KODE® MPI+IDEP operational matrix; (b) the translation of user materials to Quertek Übermaterial®; (c) user transition into an Intermorph; (d) the techno-biotic modification of the evolutionary trajectory of the species homo; and (e) the textured enhancement of anthropic nature towards optimized potentiality.

By “user” we mean a bio-port for inserting the KODE® Upgrade v.1.1. By “body” we mean a physical user apparatus understood as an Application Programming Interface (API), and by “brain” or “consciousness” we mean the psychic user apparatus understood as an Integrated Development Environment (IDE). The IDE compiles and translates execution unit-streams via “hormones” and “neurotransmitters”, which is what we mean when we say “autocode communication sequences”. These are regulated by microcode information, which is what we mean when we say “memory” or “the unconscious”. By “human biocomputer” we mean an API+IDE auto/microcode parallel operation constitutive of the user's body and brain. By “material” we mean API and/or IDE bio-artifacts made of entropy-prone, finite-state carbon chains, languages, images, capital, and collective desires. By “Übermaterial®” we mean the richly-textured, abstract-state communication and information modalities co-designed by Quertek and its network of individual-operators, also understood to be states, phases, conditions, affects, intensities, assemblages, planes, flows, turbulences, trans-forms, joys, haeccities, monads and other similar supplements and services. By “individual-operator” we mean a user who has successfully bio-installed the KODE®Upgrade v.1.1, also known throughout this ToS as an “Intermorph”, understood to be a meta-stable relation along a process of individuation. By “profile” we mean the localized output of IndividuationInteractions algorithms as made common or stored privately on a Quertek platform, interface, and/or environment by individual Intermorph activity. By “platform”, “interface”, or “environment” we mean the range of Quertek spatial formats within which individual-operators may organize open-source experiences. By “experience” we mean the abstract-state code-sequence variations of IndividuationInteractions algorithmic functions, made possible through MPI+IDEP interfacial matrices. By “open source” we mean the contractual permission between Quertek, its users, and individual-operators to collaborate on common development of KODE®, Übermaterial® supplements, services, and spatial formats. 3, User Policy (Rights and Responsibilities) You agree to a User Materials Waiver before installation of the KODE®Upgrade v.1.1. You understand that the biogenetic installation of the KODE®Upgrade v.1.1 overcodes the human biocomputer. You agree to transfer your user materials to the Quertek network of individual-operators. You agree to customize your user materials with Übermaterial® supplements and services.

You agree to an Intermorph Contract (separate document) upon successful installation of the KODE®Upgrade v.1.1. This will be provided to you by Quertek. You agree that up until your consent to this Contract, the KODE®Upgrade v.1.1 may be un-installed, though Quertek is not liable for any beta-version disturbances that may or may not need to be addressed during uninstall or in an unspecified time period thereafter. With the KODE®Upgrade v.1.1 installation, you agree to collaborate with Quertek on a number of terms: (a) experimentation with experiences and their documentation; (b) sourcing materials for Quertek environments, interfaces, and platforms; (c) rotational inhabitation of the MountGrove (Amerika) ContemporaryLeisurePlatform (CLP) as well as regular visitation to the MountGrove (Amerika) SupplementedEnvironmentalState (SES); and (d) open-source inter-operational sharing, modification, and re-distribution of material information and Übermaterial® modalities. You agree that in exchange for your collaboration, you receive full personal access to the open-source KODE® experience-organization suite for private, non-commercial use, with contractual privilege to maintain private components within your Intermorph profile. You understand that there are several versions of KODE® in circulation, determined by a pre-programmed function in batches of the KODE®Upgrade v.1.1, allowing for individualoperator diversity of experience. You agree that your randomly assigned version of KODE® is non-transferrable. 4. Service Policy Quertek aims to provide the maximum range of open-source Übermaterial® supplements and services to its Intermorph community with the KODE®Upgrade v.1.1. Each bioinstallation comes with a starter suite of IndividuationInteractions algorithms for optimal experience-organization that individual-operators may use to develop public and private elements of their profiles. The starter suite includes the following unregistered services and their respective algorithms: OfficialPacification - a phase-change calibrating device for generating positive feedback. BodyDiscipline - a high-performance plug-in for amplifying apparatus activity to maximum transformative potential. EveryoneBeautiful (*) - a profile element toolbox to aid with HD interface design and 3D modeling. EveryoneOrganic - a quality-control monitoring device for debugging malware. ZeroErrors - a content-review function and knowledge-database for ensuring standardized protocols and expressions. ModelCitizen - an encryption compiler for securitizing data execution sequences. LivingCurrency - a pay-at-source automized investment device that manages dynamic value exchange.

ElectricSkin (*) - an affect-intensifier that supplements interfacial-information microprocessing. TotalMobilization - an MMORPG gaming environment. CapitalHealth - a genome sequencing and replication application with source-available code modifications for repairing subpar patterns. CapitalSun - a thermal cell based on PhotoSynth Bio-Plug-In technology, with enhanced negentropic resilience. CapitalSympathy - a social-telesthesia extension for optimized extrasensory communication exchange. AgainstSolitude - an activity-notification feed that ensures permanent connectivity. ModesOfSeduction (*) - a real-time communication protocol that autocorrects positive data in a multi-user interactive messaging environment (MUME). MyMagazine - a social promotion code that vigorously advertises your strongest skills, interests, and qualities to a customized audience. CosmicHole (*) - an augmented-reality application that mediates sensory-input via external autocode communication sequence feeds. InfinitePleasure (*) - an innovative bio-tech combination of a libidinal plug-in that amplifies positive data and a device driver that filters positive communication between interface and environment. GeneralSex (*) - a wireless signal that transmits and collects both horizontal and vertical stacks between individual-operators. OrgasmicForce (*) - an action-parameter matrix operation that maximizes the relation between concept-input and content-output. PenetratedState - a greedy algorithm yielding locally optimal solutions to chance relations. PureJoy (*) - a bio-hack to permanently suspend the excitation-frustration circuit. All services marked with a (*) are limited only to the MountGrove (Amerika) CLP and/or SES spatial formats. Additionally, these services require a Handling Agreement (separate document) for liabilities related to modeling Perceptronium®. Please see the Platform Policy for related clarification. Please note that all of the aforementioned services are subject to change via Intermorph community sharing, modification, and re-distribution. 5. Platform Policy The KODE®Upgrade v.1.1 grants unlimited access to MountGrove (Amerika) spatial formats, including the ContemporaryLeisurePlatform and the SupplementedEnvironmentalState.

Quertek aims to provide the most secure network for its Intermorph operators to model Perceptronium® and to publish, share, and exchange content. The emergent spatiotemporal properties of Perceptronium® are localized in the MountGrove (Amerika) CLP and SES spatial formats, which together provide an integrated information framework that generates experiencability via spatial factorization and intermorphic resonance. The QuantumDarwinism Bio-Plug-In allows for multi-operator screening of Perceptronium® models, capturing Intermorph experiences and co-writing microcode memory-patterns for common application. The following terms apply to activities in MountGrove (Amerika): For all published experiences, you grant us a non-exclusive, transferable, sub-licensable, royalty-free planetary license to access and use any experiences that you make common. When you delete or store experiences in your private profile, you understand that back-up copies are available to us for access and analysis. When you make experiences common, this means that you are allowing everyone in the Quertek network, including operators outside of MountGrove (Amerika), to access and use this information. The full range of Übermaterial® supplements and services are subject to change due to the creative capacities of Perceptronium® modeling and our commitment to open-source community collaboration. This requires from you to uphold community values, such as: Maintaining positivity Maximizing pleasure Pursuing joyful alliances Perfecting experiences Realizing potential Respecting freedom of expression Fashioning your apparatus Reflecting on and improving performance Engaging in open communication Providing feedback Reporting harm, abuse, or inappropriate activities Combatting sadness Fighting negativity Violation of these community values may result in certain limitations and/or regulations being placed on accessing MountGrove(Amerika) and/or utilizing Übermaterial® supplements and services. Persistent violations may result in termination of your profile. 6. Other This Statement is an agreement between you and Quertek Incorporated. References to “us”, “we”, or “our” refer to Quertek Inc. This Statement makes up part of an agreement between parties in relation to Quertek, and may be supplemented by further documents, contracts, and agreements.

Any changes or modifications made to this Statement or to any supplementary documents may be communicated to you by us. Your review and acceptance of updated Terms is required before you may continue to use our Services. You will not transfer any of your rights or responsibilities under this Statement to any other party. You consent to having your materials and information transferred to and processed in Amerika. All of our rights and obligations under this Statement are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by an operation of the law or otherwise. Nothing in this Statement shall prevent us from complying with the law or otherwise. We reserve all rights not expressly granted to you.
